What is the Neutrality of Support Managers and Staff?
There is a regulation that states that support managers and personnel must be "neutral" to be deemed qualified.
A neutral person is defined as someone who works in a different department from the applicant for the Specified Skilled Worker (i) visa and does not have any supervisory authority over the said foreign worker. However, even if they are from a different department, individuals such as the representative director or the head who supervises the department to which the foreign worker belongs, and who would be in a vertical line if an organizational chart were created, are considered to be in a supervisory position over the foreign worker and thus are not deemed qualified.
Additionally, spouses or relatives within the second degree of kinship of the officers of the Specified Skilled Worker organization, as well as those who have a close social relationship with the officers of the receiving organization, are also deemed not to be qualified.
When accepting Specified Skilled Worker (i) under in-house support, it is necessary to confirm the qualifications of the support managers and personnel in advance.
