Difference between a 30-day and 31-day stay in "Specific Activities"
If an application for update or change is denied, a "Specific Activity" residence status is granted to prepare for returning to one's home country.
There are two types of "Specific Activity" residence status for preparing to return, one with a duration of 30 days and the other with 31 days.
Although there is only a one-day difference in the duration of stay between 30 days and 31 days, there are significant differences as follows:
- For a duration of 30 days: It is not possible to apply for a change of residence status.
- For a duration of 31 days: It is possible to apply for a change of residence status.
This is because, in the case of a duration of 30 days, the "special period" of residence status does not apply, while in the case of a duration of 31 days, this "special period" does apply.
Therefore, if a person with a duration of 31 days applies before the expiration of their stay, they can stay until the earlier of the date when the result is announced or two months after the expiration date of the 31-day stay.
